Terms of Service

1. Acceptance of Terms

By accessing or using Craftix ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not access or use the Service. We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years old to use Craftix. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete information when registering
• Use a strong, unique password and keep it confidential. Craftix will never ask for your password via email, chat, or any channel other than the login page.
• Notify us immediately at hello@craftix.co of any unauthorised use of your account or suspected password compromise
• Not share your account with others or create multiple accounts to circumvent plan limits

4. The Service

Craftix is an AI-powered sticker and image generation platform. We use third-party AI models to generate images based on your text prompts. You acknowledge that:

• AI-generated outputs may be unpredictable, imperfect, or inconsistent with your expectations
• We do not guarantee that generated content will be original, unique, or free from third-party intellectual property claims
• We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice
• Stickers are consumed when a generation is submitted, regardless of whether you are satisfied with the output

5. Content Policy

You are solely responsible for the prompts you submit and the outputs you generate. You must not use Craftix to generate, store, or distribute content that:

• Is sexually explicit or involves minors in any sexual context
• Is violent, threatening, or promotes self-harm
• Is defamatory, harassing, or invasive of another person's privacy
• Infringes on third-party intellectual property, trademarks, or copyright
• Depicts real individuals in a misleading, harmful, or non-consensual manner
• Is illegal under Australian law or the law of your jurisdiction

We use automated content filtering, but you acknowledge that no system is perfect. We reserve the right to review and remove content that violates this policy.

6. Intellectual Property

Your content: Subject to these Terms, you retain ownership of the images you generate using the Service on paid plans. Free tier outputs are licensed for personal, non-commercial use only.

Your licence to us: By using the Service, you grant Craftix a limited, non-exclusive, royalty-free licence to process your prompts and temporarily store generated images solely to provide the Service to you.

Your warranty: You warrant that your prompts do not infringe the intellectual property rights of any third party. You agree to indemnify Craftix for any claims arising from your breach of this warranty.

Craftix IP: The Craftix name, logo, website, and software are owned by Craftix and protected by applicable intellectual property laws. Nothing in these Terms grants you a right to use our branding or trademarks.

7. Subscriptions & Billing

Paid plans are billed on a monthly or annual basis as selected at checkout. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date
• Sticker reset: Monthly stickers reset at the start of each new billing cycle. Unused stickers do not roll over
• Plan changes: Upgrades take effect immediately. Downgrades take effect at the next billing cycle
• Cancellation: You may cancel at any time via the billing portal in your settings. Access continues until the end of your paid period
• Price changes: We will provide at least 30 days' notice of any price increase to existing subscribers

9. Suspension & Termination

We may suspend or permanently terminate your account at our discretion if you:

• Violate these Terms or our Content Policy
• Attempt to circumvent technical limits, access controls, or billing systems
• Engage in abusive, fraudulent, or illegal activity

In the case of a serious violation, we may terminate without prior notice. Where termination is not due to a violation, we will provide reasonable notice. You may terminate your account at any time via the Settings page.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your requirements.

11. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, Craftix and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the Service. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to Craftix in the 12 months preceding the claim.

Nothing in these Terms limits or excludes any rights you have under the Australian Consumer Law that cannot lawfully be excluded.

12. Indemnification

You agree to indemnify and hold harmless Craftix, its operators, and affiliates from any claims, losses, damages, or expenses (including legal fees) arising from: (a) your use of the Service; (b) content you submit or generate; (c) your violation of these Terms; or (d) your infringement of any third-party rights.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Victoria, Australia. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.

15. Copyright & Intellectual Property Complaints

Craftix respects the intellectual property rights of others and expects users to do the same. We have implemented automated content filtering to block prompts that reference known copyrighted characters, brands, and trademarks. However, no automated system is perfect.

To report a copyright or IP infringement: If you believe that content generated or stored on Craftix infringes your copyright or other intellectual property rights, please send a written notice to hello@craftix.co with the subject line "Copyright Complaint" and include:

• Identification of the copyrighted work you claim has been infringed
• A description of the infringing content and where it appears on our platform
• Your contact information (name, email address)
• A statement that you have a good faith belief that the use is not authorised by the copyright owner
• A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf

We will review all valid notices and take appropriate action, which may include removing the infringing content and suspending or terminating the account of the user responsible. Repeated infringers will have their accounts terminated.
